WHAT IS TH E-2 INVESTOR VISA? WHO CAN APPLY? 27 May 2025

What is the E-2 Investor Visa?

The E-2 Investor Visa is a type of non-immigrant visa granted to nationals of countries that have a treaty of commerce and navigation with the United States. It allows individuals to reside and work in the U.S. by either establishing an active business or becoming a partner in an existing one. With this visa, the investor can both live in the U.S. and personally manage their business.

Does the E-2 Visa grant residency in the U.S.?

Yes. The E-2 visa provides legal authorization to reside and work in the United States. However, it is a non-immigrant visa issued for a temporary period and can be renewed as long as the investment is maintained. The E-2 visa does not lead directly to a Green Card, but the investor may live in the U.S. with their family.

Who can apply for an E-2 Visa?

To be eligible for an E-2 visa, the applicant must:

• Be a national of a country that has an E-2 treaty with the United States (e.g., Turkey),

• Have made or be in the process of making a qualifying investment in an active U.S. business,

• Make a “substantial” investment,

• Invest in a “real and operating” commercial enterprise,

• Have a controlling interest and be responsible for the enterprise’s development and direction.

How much investment is required for an E-2 Visa?

There is no fixed minimum amount required by law. What matters is whether the investment is considered sufficient in relation to the type of business. Thus, the amount may vary depending on factors such as the industry, the business structure, and the location. Some low-capital but demonstrably sustainable business models may also qualify.

What types of businesses qualify for the E-2 Visa?

There are no specific restrictions on the sectors eligible for E-2 investment. However, the business must be active, generate employment, and be personally managed by the investor.

Can family members benefit from the E-2 Visa?

Yes. The spouse and children under the age of 21 of an E-2 investor may be included in the visa application. The spouse can obtain a work permit in the U.S., and children can attend school. This is a major advantage for investors planning to relocate with their family.

How long is the E-2 Visa valid? Can it be renewed?

For Turkish nationals, the E-2 visa is typically issued for five years. However, each entry into the U.S. usually grants a stay of up to two years. As long as the investment continues and the visa conditions are met, the visa can be renewed indefinitely.

Can the E-2 Visa lead to a Green Card?

The E-2 visa does not directly provide a Green Card (permanent residency). However, if the investor qualifies and plans to apply through another immigration pathway, the E-2 visa can serve as a stepping stone in the process.

Is it necessary to seek professional support for the E-2 application?

Yes. The E-2 visa process requires a comprehensive business plan, financial documentation, proof of investment, and evidence demonstrating the sustainability of the business. Therefore, legal and strategic consultancy is crucial for a successful application. In particular, setting up the business structure, documenting the investment, and preparing a business plan that meets visa requirements require a professional approach.
